As we will not be able to hold our annual Liability insurance conference at Cambridge this year, we will be arranging a number of online lectures over September and October.
Massimo Vascotto will give a presentation entitled “Throwing Employees Under A Bus”
This presentation looks at the boundaries between employers’ liability and motor insurance. In the case of a motor accident involving employees at work, which policy should respond: the employers’ Liability or the motor insurance policy? Massimo will look at the specific provisions of the Employers Liability Compulsory Insurance Act 1969 and the Employers Liability Regulations 1998 vis-à-vis the Road Traffic Act 1988 to determine how these Acts, and the relevant statutory liability insurance provisions, interact. He will consider some accident scenarios to determine in practice the interaction. A claim falling under an employers’ liability policy instead of a motor policy can have serious implications, particularly for the insured. Massimo will propose a new Employers’ Liability exclusion clause in light of this analysis and will highlight further areas which could give rise to unexpected outcomes and challenges in terms of policy coverage.
Massimo is the current Chairman of the Liability Insurance Group of the International Underwriting Association of London (IUA). He has nearly 25 years’ experience in liability insurance underwriting, of which over 20 in London with Assicurazioni Generali. He is the author of the CII Study Text Liability Insurances and other publications for the Chartered Insurance Institute and for the IUA. He is also a guest speaker on liability insurance at Sir John Cass Business School in London, at the Master of Insurance and Risk Management in Trieste and at various universities in Italy. Massimo has a degree in International and Diplomatic Sciences from the University of Trieste (Italy) and is a Fellow of the Chartered Insurance Institute.
The presentation starts at 3.30pm and will last for about an hour.
There is no fee involved in attending this lecture but as places are limited, anyone booking a place is expected to attend.
